Inserted: For an additional amount for funding the Covered Countermeasures Process Fund under section 319F-4 of the Public Health Service Act (42 U.S.C. 247d-6e), $289,000,000: Provided, That no funds appropriated under this Act or any other provision of law shall be used to issue a declaration under section 319F-3(b) of such Act (42 U.S.C. 247d-6d(b)) that specifies any countermeasure other than a vaccine for pandemic influenza: Provided further, That the amounts provided for under this section shall be designated as an emergency requirement pursuant to section 402 of H. Con. Res. 95 (109th Congress): Provided further, That amounts provided for under this section shall remain available until expended.

SA 3689. Mr. KENNEDY submitted an amendment intended to be proposed by him to the bill H.R. 4939, making emergency supplemental appropriations for the fiscal year ending September 30, 2006, and for other purposes; which was ordered to lie on the table; as follows:
At the appropriate place, insert the following:
SEC. __. FUNDING FOR THE COVERED COUNTERMEASURES PROCESS FUND.
