Inserted: (a) In General.--Notwithstanding any other provision of law, for purposes of the Federal Food, Drug, and, Costmetic Act (21 U.S.C. 301 et seq.) the term "lobster" may not be used to label or advertise the sale of any seafood product from the infraorder Garidea or Anomura.
Inserted: (b) Misbranded Food.--Section 403 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 343) is amended by adding at the end the following:
Inserted: (y) Lobster.--If it purports to be, or is represented as being, lobster but is from the infraorder Caridea or Anomura.".

SA 1048. Ms. SNOWE submitted an amendment intended to be proposed by her to the bill S. 1082, to amend the Federal Food, Drug, and Cosmetic Act to reauthorize and amend the prescription drug user fee provisions, and for other purposes; which was ordered to lie on the table; as follows:
At the appropriate place, insert the following:
SEC. __. MARKETING OF CERTAIN CRUSTACEANS.
(a) In General.--Notwithstanding any other provision of law, for purposes of the Federal Food, Drug, and, Costmetic Act (21 U.S.C. 301 et seq.) the term “lobster” may not be used to label or advertise the sale of any seafood product from the infraorder Garidea or Anomura.
(b) Misbranded Food.--Section 403 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 343) is amended by adding at the end the following:
