Inserted: Section 1244 of the National Defense Authorization Act of Fiscal Year 2008 (Public Law 110-181; 122 Stat. 396) is amended--
Inserted: (1) by redesignating subsection (h) as subsection (i); and
Inserted: (2) by inserting after subsection (g) the following:
Inserted: "(h) Adjustment of Status.--Notwithstanding paragraphs (2), (7), or (8) of subsection (c) of section 245 of the Immigration and Nationality Act (8 U.S.C. 1255), the Secretary of Homeland Security may adjust the status of an alien described in subsection (b) to that of an alien lawfully admitted for permanent residence under subsection (a) of such section 245 if the alien--
Inserted: "(1) was paroled or admitted as a nonimmigrant into the United States; and
Inserted: "(2) is otherwise eligible for special immigrant status under this section and under the Immigration and Nationality Act (8 U.S.C. 1101 et seq.)).".

Mr. CARDIN submitted an amendment intended to be proposed by him to the bill S. 3001, to authorize appropriations for fiscal year 2009 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table; as follows:
At the end of subtitle C of title XII, add the following:
SEC. 1222. ADJUSTMENT OF STATUS FOR CERTAIN IRAQIS.
Section 1244 of the National Defense Authorization Act of Fiscal Year 2008 (Public Law 110-181; 122 Stat. 396) is amended--
(1) by redesignating subsection (h) as subsection (i); and
(2) by inserting after subsection (g) the following:
