Inserted: (a) Treatment.--Section 1965 of title 38, United States Code, is amended--
Inserted: (1) in paragraph (10), by adding at the end the following new subparagraph:
Inserted: "(C) The member's stillborn natural child."; and
Inserted: (2) by adding at the end the following new paragraph:
Inserted: "(11) The term 'stillborn natural child' means a natural child--
Inserted: "(A) whose death occurs before expulsion, extraction, or delivery; and
Inserted: "(B) whose--
Inserted: "(i) fetal weight is greater than 500 grams;
Inserted: "(ii) in the event fetal weight is unknown, duration in utero exceeds 22 completed weeks of gestation; or
Inserted: "(iii) in the event neither fetal weight nor duration in utero is known, body length (crown-to-heel) is 25 centimeters or more.".
Inserted: (b) Conforming Amendment.--Section 101(4)(A) of such title is amended by striking "section 1965(10)(B)" in the matter preceding clause (i) and inserting "subparagraph (B) or (C) of section 1965(10)".

Mr. VITTER submitted an amendment intended to be proposed by him to the bill S. 3001, to authorize appropriations for fiscal year 2009 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table; as follows:
At the end of subtitle G of title X, add the following:
SEC. 1083. TREATMENT OF STILLBORN CHILDREN AS INSURABLE DEPENDENTS UNDER SERVICEMEMBERS' GROUP LIFE INSURANCE.
(a) Treatment.--Section 1965 of title 38, United States Code, is amended--
(1) in paragraph (10), by adding at the end the following new subparagraph:
“(C) The member's stillborn natural child.”; and
(2) by adding at the end the following new paragraph:
“(11) The term ‘stillborn natural child' means a natural child--
“(A) whose death occurs before expulsion, extraction, or delivery; and
“(B) whose--
“(i) fetal weight is greater than 500 grams;
“(ii) in the event fetal weight is unknown, duration in utero exceeds 22 completed weeks of gestation; or
“(iii) in the event neither fetal weight nor duration in utero is known, body length (crown-to-heel) is 25 centimeters or more.”.
