Inserted: Section 1145(a) of title 10, United States Code, is amended--
Inserted: (1) in paragraph (1)(A), by inserting "except as provided in paragraph (3)," before "medical and dental care";
Inserted: (2) by redesignating paragraphs (3), (4), (5), and (6) as paragraphs (4), (5), (6), and (7), respectively;
Inserted: (3) by inserting after paragraph (2) the following new paragraph (3):
Inserted: "(3) In the case of a member described in paragraph (2)(B), the dental care to which the member is entitled under this subsection shall be the dental care to which a member of the uniformed services on active duty for more than 30 days is entitled under section 1074 of this title."; and
Inserted: (4) in subparagraph (A) of paragraph (6), as redesignated by paragraph (2) of this section, by striking "paragraph (4)" and inserting "paragraph (5)".

Mr. NELSON (for himself and Mr. Graham) submitted an amendment intended to be proposed by him to the bill S. 3001, to authorize appropriations for fiscal year 2009 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table; as follows:
At the end of subtitle B of title VII, add the following:
SEC. 714. ENHANCEMENT OF TRANSITIONAL DENTAL CARE FOR MEMBERS OF THE RESERVE COMPONENTS ON ACTIVE DUTY FOR MORE THAN 30 DAYS IN SUPPORT OF A CONTINGENCY OPERATION.
Section 1145(a) of title 10, United States Code, is amended--
(1) in paragraph (1)(A), by inserting “except as provided in paragraph (3),” before “medical and dental care”;
(2) by redesignating paragraphs (3), (4), (5), and (6) as paragraphs (4), (5), (6), and (7), respectively;
(3) by inserting after paragraph (2) the following new paragraph (3):
“(3) In the case of a member described in paragraph (2)(B), the dental care to which the member is entitled under this subsection shall be the dental care to which a member of the uniformed services on active duty for more than 30 days is entitled under section 1074 of this title.”; and
(4) in subparagraph (A) of paragraph (6), as redesignated by paragraph (2) of this section, by striking “paragraph (4)” and inserting “paragraph (5)”.
