1. Adds SEC. 854. SMALL ARMS PRODUCTION INDUSTRIAL BASE MATTERS at the end of subtitle F of title VIII

   Section 813 of the National Defense Authorization Act for Fiscal Year 2004 (Public Law 108-136; 117 Stat. 1543) is repealed.

   Inserted: SEC. 854. SMALL ARMS PRODUCTION INDUSTRIAL BASE MATTERS.

   Inserted: (a) Authority to Modify Definition of "Small Arms Production Industrial Base".--Section 2473(c) of title 10, United States Code, is amended by inserting before the period at the end the following: ", and any subsequent modifications to such list of firms pursuant to a review by the Secretary of Defense".

   Inserted: (b) Review of Small Arms Production Industrial Base.--Not later than September 30, 2009, the Secretary of Defense shall review and determine, based upon manufacturing capability and capacity--

   Inserted: (1) whether any firms included in the small arms production industrial base should be eliminated or modified and whether any additional firms should be included; and

   Inserted: (2) whether any of the small arms listed in section 2473(d) of title 10, United States Code, should be eliminated from the list or modified on the list, and whether any additional small arms should be included in the list.
