Inserted: Sec. 4__. Notwithstanding any other provision of law, for fiscal year 2010, no funds may be used by the Administrator of the Environmental Protection Agency to regulate emissions of carbon dioxide from stationary sources under any final version of the proposed rule of the Administrator entitled "Proposed Endangerment and Cause or Contribute Findings for Greenhouse Gases Under Section 202(a) of the Clean Air Act" (74 Fed. Reg. 18886 (April 24, 2009)) if the regulation of those emissions would increase electricity or gasoline prices, as determined by the Energy Information Administration.

Mr. THUNE submitted an amendment intended to be proposed by him to the bill H.R. 2996, making appropriations for the Department of the Interior, environment, and related agencies for the fiscal year ending September 30, 2010, and for other purposes; which was ordered to lie on the table; as follows:
On page 240, between lines 13 and 14, insert the following:
