Inserted: SEC. 1088. EXCEPTION TO THE MEDICARE EXPANSION RESTRICTIONS FOR PHYSICIAN-OWNED HOSPITALS FOR CERTAIN HOSPITALS LOCATED NEAR A MILITARY INSTALLATION.
Inserted: (a) In General.--Section 1877(i) of the Social Security Act (42 U.S.C. 1395nn(i)) is amended--
Inserted: (1) in paragraph (1)(B), by striking "paragraph (3)" and inserting "paragraphs (3) and (7)"; and
Inserted: (2) by adding at the end the following new paragraph:
Inserted: "(7) Additional exception to prohibition on expansion of facility capacity.--
Inserted: "(A) In general.--The requirement under paragraph (1)(B) shall not apply to a hospital described in subparagraph (B).
Inserted: "(B) Hospital described.--A hospital is described in this subparagraph if it meets the following requirements:
Inserted: "(i) The hospital makes emergency services available 24 hours a day and 7 days a week.
Inserted: "(ii) The hospital is an authorized provider of health care services under the TRICARE program.
Inserted: "(iii) The hospital is located within 75 road miles of a United States military installation (as defined by the Secretary of Defense).".
Inserted: (b) Effective Date.--The amendments made by subsection (a) shall take effect on the date of the enactment of this Act.

Mr. INHOFE submitted an amendment intended to be proposed by him to the bill S. 1867, to authorize appropriations for fiscal year 2012 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table; as follows:
At the end of subtitle H of title X, add the following:
SEC. 1088. EXCEPTION TO THE MEDICARE EXPANSION RESTRICTIONS FOR PHYSICIAN-OWNED HOSPITALS FOR CERTAIN HOSPITALS LOCATED NEAR A MILITARY INSTALLATION.
