1. Adds SEC. __. PARTICIPATION BY COOPERATIVE GROCERIES wherever appropriate

   Adds a section

   Inserted: SEC. __. PARTICIPATION BY COOPERATIVE GROCERIES.

   Inserted: (a) Amendment.--Section 7(a) of the Small Business Act (15 U.S.C. 636(a)) is amended by adding at the end the following:

   Inserted: "(36) Cooperative groceries.--

   Inserted: "(A) Definition.--In this paragraph, the term 'cooperative grocery' means a business concern organized as a cooperative that--

   Inserted: "(i) is owned by not fewer than 150 and not more than 20,000 individuals--

   Inserted: "(I) that are customers or employees of the business concern; and

   Inserted: "(II) no 1 of which owns more than 1 share of the business concern;

   Inserted: "(ii) distributes any portion of the profits of the business concern to the owners of the cooperative; and

   Inserted: "(iii) operates a physical storefront selling a variety of fruits, vegetables, and dairy products.

   Inserted: "(B) Eligibility.--Notwithstanding section 120.110 of title 13, Code of Federal Regulations, for purposes of this subsection, a cooperative grocery shall be deemed to be a small business concern.".

   Inserted: (b) Technical Amendment.--Section 1133(b) of the Small Business Jobs Act of 2010 (15 U.S.C. 636 note) is amended--

   Inserted: (1) in paragraph (1), by striking "and" at the end;

   Inserted: (3) by adding at the end the following:

   Inserted: "(3) by redesignating paragraph (36), as added by the SBIR/STTR Reauthorization Act of 2011, as paragraph (35).".
