Inserted: Section 3(k) of the Food and Nutrition Act of 2008 (7 U.S.C. 2012(k)) is amended by inserting before the period at the end the following: ", except that a food, food product, meal, or other item described in this subsection shall be considered a food under this Act only if the Secretary determines that the food, food product, meal, or other item is necessary for essential nutrition".

SA 2419. Mr. DeMINT submitted an amendment intended to be proposed by him to the bill S. 3240, to reauthorize agricultural programs through 2017, and for other purposes; which was ordered to lie on the table; as follows:
At the appropriate place, insert the following:
