SA 2161. Mr. SULLIVAN submitted an amendment intended to be proposed by him to the bill S. 4638, to authorize appropriations for fiscal year 2025 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table; as follows: At the end of subtitle F of title XII, add the following: SEC. 1291. CONTRACT MODIFICATIONS UNDER FOREIGN MILITARY SALES PROCESS. (a) In General.--A contract between the United States Government and a manufacturer of United States defense articles-- (1) may be modified at any time for the purpose of the acquisition of defense articles or services pursuant to a letter of offer and acceptance with an eligible foreign purchaser; and (2) shall not be subject to an annual limitations with respect to the number of times the contract may be modified. (b) Costs.--Costs associated with a modification under subsection (a) shall be paid by the eligible foreign purchaser concerned. ______
