SA 2852. Mr. HICKENLOOPER (for himself, Mr. Bennet, and Mr. Kaine) submitted an amendment intended to be proposed by him to the bill S. 4638, to authorize appropriations for fiscal year 2025 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table; as follows: At the end of subtitle A of title VII, add the following: SEC. 710. GENERAL TEMPORARY MILITARY CONTINGENCY PAYMENT ADJUSTMENT FOR CHILDREN'S HOSPITALS. (1) In general.--The Secretary of Defense shall provide a general temporary military contingency payment adjustment for any children's hospital that-- (A) has 10 percent or more of its revenue come from the TRICARE program for care of members of the Armed Forces on active duty and their dependents; (B) has 10,000 or more TRICARE program visits paid under the Hospital Outpatient Prospective Payment System for members of the Armed Forces on active duty and their dependents annually; and (C) is determined by the Secretary to be essential for TRICARE program operations. (2) Criteria for determination.--Not later than 180 days after the date of the enactment of this Act, the Director of the Defense Health Agency shall publish a list of criteria that the Secretary shall use to determine whether a children's hospital is essential for TRICARE program operations under paragraph (1)(C). (3) Definitions.--In this section: (A) Active duty.--The term ``active duty'' has the meaning given that term in section 101(18) of title 37, United States Code. (B) Dependent.--The term ``dependent'' has the meaning given that term in section 1072 of title 10, United States Code. (C) TRICARE program.--The term ``TRICARE program'' has the meaning given that term in section 1072(7) of title 10, United States Code. ______
