SA 396. Mr. LANKFORD submitted an amendment intended to be proposed by him to the bill S. 2226, to authorize appropriations for fiscal year 2024 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table; as follows: At the appropriate place in subtitle B of title X, insert the following: SEC. 101__. NATIONAL SECURITY-BASED THREAT ASSESSMENT. Not later than 180 days after the date of the enactment of this Act, the Chief of the U.S. Border Patrol, in conjunction with the Under Secretary of Commerce for Industry and Security and the Director of National Intelligence, shall develop and submit to the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Armed Services of the Senate, the Committee on Homeland Security of the House of Representatives, and the Committee on Armed Services of the House of Representatives a threat assessment that-- (1) is related to the technologies that are commonly used to construct illicit, cross-border tunnels; (2) is focused on-- (A) identifying the technologies that could be used to construct such tunnels; (B) how such technologies can be acquired; and (C) whether such technologies should be subject to additional regulations, export controls, or other regulatory measures to safeguard the national security of the United States; and (3) considers whether any entities should be added to the Entity List maintained by the Bureau of Industry and Security of the Department of Commerce and set forth in Supplement No. 4 to part 744 of title 15, Code of Federal Regulations. ______
