SA 3747. Mr. DAINES submitted an amendment intended to be proposed by him to the bill S. 2296, to authorize appropriations for fiscal year 2026 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table; as follows: At the end of subtitle A of title XII, add the following: SEC. 1210. LIMITATION ON CERTAIN PHARMACEUTICALS DEVELOPED BY OR BENEFITTING THE WORLD HEALTH ORGANIZATION. (a) In General.--Except as provided under subsection (b), the Department of Defense, the Department of State, and the Central Intelligence Agency may not administer or supply any pharmaceutical product-- (1) that was discovered, developed, or produced through assistance received from-- (A) the World Health Organization; or (B) any entity that used World Health Organization grant funds to provide such assistance; or (2) the sale or distribution of which financially benefits the World Health Organization. (b) Exemption.--The prohibition set forth in subsection (a) shall not apply with respect to any pharmaceutical product that the Secretary of Defense, the Secretary of State, or the Director of the Central Intelligence Agency, as applicable, determines-- (1) the administration or supply of which is vital to the mission of the department or agency headed by such official; and (2) cannot be safely and effectively replaced by a pharmaceutical product that is not prohibited under subsection (a). ______
