SA 5379. Mr. WELCH submitted an amendment intended to be proposed by him to the concurrent resolution S. Con. Res. 33, setting forth the congressional budget for the United States Government for fiscal year 2026 and setting forth the appropriate budgetary levels for fiscal years 2027 through 2035; which was ordered to lie on the table; as follows: At the end of title III, add the following: SEC. 3___. DEFICIT-NEUTRAL RESERVE FUND RELATING TO REDIRECTING AND RESCINDING CERTAIN FUNDS APPROPRIATED UNDER THE ONE BIG BEAUTIFUL BILL ACT, SO THAT BLOCKBUSTER ORPHAN DRUGS AREN'T EXEMPT FROM MEDICARE DRUG PRICE NEGOTIATION. The Chairman of the Committee on the Budget of the Senate may revise the allocations of a committee or committees, aggregates, and other appropriate levels in this resolution, and make adjustments to the pay-as-you-go ledger, for one or more bills, joint resolutions, amendments, amendments between the Houses, motions, or conference reports relating to redirecting and rescinding certain funds appropriated under Public Law 119-21 (commonly known as the ``One Big Beautiful Bill Act''), so that Blockbuster orphan drugs aren't exempt from Medicare drug price negotiation, which may include repealing section 71203 of such Act to ensure that Medicare can negotiate drug prices for rare disease drugs when Medicare spending exceeds $400,000,000 annually on that drug, regardless of the drug's orphan status, and paying for such repeal by rescinding funds appropriated under sections 90003 and 100052 of such Act, including rescinding funds appropriated for the Department of Homeland Security, Immigration and Customs Enforcement, or Customs and Border Patrol, by the amounts provided in such legislation for those purposes, provided that such legislation would not increase the deficit over the period of the total of fiscal years 2026 through 2035. ______
