A BILL

To amend the Transportation Equity Act for the 21st Century with
respect to NAFTA corridor planning and development and coordinated
border infrastructure and safety.

Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,

SECTION 1. NAFTA CORRIDOR PLANNING AND DEVELOPMENT.

(a) Eligibility of Corridors.--Section 1118(b) of the
Transportation Equity Act for the 21st Century (23 U.S.C. 101 note; 112
Stat. 161) is amended to read as follows:
``(b) Eligibility of Corridors.--
``(1) In general.--The Secretary may make allocations under
this section with respect to high priority corridors identified
in section 1105(c) of the Intermodal Surface Transportation
Efficiency Act of 1991 (105 Stat. 2032) that connect to the
border between the United States and Mexico or the United
States and Canada.
``(2) Priority.--In making allocations under this section,
the Secretary shall give priority consideration to corridors on
which traffic has increased since the date of enactment of the
North American Free Trade Agreement Implementation Act and is
projected to increase in the future.''.
(b) Applicability of Title 23.--Section 1118(e) of such Act (23
U.S.C. 101 note; 112 Stat. 162) is amended--
(1) by striking ``by section 1101 of this Act''; and
(2) by striking ``and section 1119''.
(c) Authorization of Appropriations.--Section 1118 of such Act (23
U.S.C. 101 note; 112 Stat. 161) is amended by adding at the end the
following:
``(h) Authorization of Appropriations.--There is authorized to be
appropriated out of the Highway Trust Fund (other than the Mass Transit
Account) to the Secretary to carry out this section $200,000,000 for
each of the fiscal years 2004 through 2009.''.
(d) Conforming Amendments.--
(1) Section heading.--The heading for section 1118 of such
Act (23 U.S.C. 101 note; 112 Stat. 161) is amended by striking
``national'' and inserting ``nafta''.
(2) Table of contents.--Section 1(b) of such Act (112 Stat.
107) is amended by striking the item relating to section 1118
and inserting the following:

``Sec. 1118. NAFTA corridor planning and development
program.''.

SEC. 2. COORDINATED BORDER INFRASTRUCTURE.

Section 1119 of the Transportation Equity Act for the 21st Century
(23 U.S.C. 101 note) is amended by adding at the end the following:
``(f) Funding.--
``(1) Authorization of appropriations.--There is authorized
to be appropriated out of the Highway Trust Fund (other than
the Mass Transit Account) to the Secretary to carry out this
section $200,000,000 for each of the fiscal years 2004 through
2009.
``(2) Applicability of title 23.--Funds made available to
carry out this section shall be available for obligation in the
same manner as if such funds were apportioned under chapter 1
of title 23, United States Code.''.
