IN THE SENATE OF THE UNITED STATES

Mr. Grassley introduced the following bill; which was read twice and
referred to the Committee on the Judiciary

A BILL

To amend title 18 of the United States Code to increase the penalties
for smuggling goods into the United States.

Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,

SECTION 1. INCREASED PENALTY.

The third undesignated paragraph of section 545, United States
Code, is amended by striking ``five years'' and inserting ``20 years''.

SEC. 2. ENHANCED PENALTY FOR CAUSING DEATH.

(a) Amendment of Federal Sentencing Guidelines.--Pursuant to its
authority under section 994 of title 28, United States Code, the United
States Sentencing Commission shall amend the Federal sentencing
guidelines to provide sentencing enhancements for an offense under
section 545 of title 18, United States Code, as amended by this Act,
that results in the death of a person.
(b) Consistency With Other Guidelines.--In carrying out this
section, the United States Sentencing Commission shall--
(1) ensure that there is reasonable consistency with other
Federal sentencing guidelines; and
(2) avoid duplicative punishments for substantially the
same offense.
