A BILL
To authorize the Secretary of the Interior to acquire the McLoughlin
House National Historic Site in Oregon City, Oregon, for inclusion in
the Fort Vancouver National Historic Site, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``McLoughlin House National Historic
Site Act''.
SEC. 2. FINDINGS.
Congress finds that--
(1) on June 27, 1941, in accordance with section 2 of the
Act of August 21, 1935 (16 U.S.C. 462), Acting Assistant
Secretary of the Interior W.C. Mendenhall established the
McLoughlin Home National Historic Site in Oregon City, Oregon;
(2) in 1941, the McLoughlin Memorial Association, the city
of Oregon City, Oregon, and the United States entered into a
cooperative agreement providing for the preservation and use of
the McLoughlin House as a national historic site;
(3) on January 16, 1945, the Historic Site was redesignated
as the McLoughlin House National Historic Site;
(4) the Historic Site is located in a charter park on land
owned by the City described as ``Oregon City Block 40'';
(5) the Historic Site includes the McLoughlin House and
Barclay House, which are owned and managed by the Association;
(6) while the Association has had an exemplary and
longstanding role in the stewardship of the Historic Site, the
Association is unable to continue that role; and
(7) the Historic Site has been an affiliated area of the
National Park System and is worthy of recognition as a unit of
the National Park System.
SEC. 3. DEFINITIONS.
In this Act:
(1) Association.--The term ``Association'' means the
McLoughlin Memorial Association, an organization that is
described in section 501(c)(3) of the Internal Revenue Code of
1986 and exempt from taxation under section 501(a) of the Code.
(2) City.--The term ``City'' means Oregon City, Oregon.
(3) Historic site.--
(A) In general.--The term ``Historic Site'' means
the McLoughlin House National Historic Site that is--
(i) described in the Order of the Acting
Assistant Secretary of the Interior dated June
27, 1941; and
(ii) generally depicted on the map entitled
``McLoughlin House National Historic Site'',
numbered 007/80,000, and dated December 1,
2001.
(B) Inclusions.--The term ``Historic Site''
includes the McLoughlin House, the Barclay House, and
other real property, improvements, and personal
property that are associated with the McLoughlin House
and the Barclay House.
(4) Secretary.--The term ``Secretary'' means the Secretary
of the Interior.
SEC. 4. MCLOUGHLIN HOUSE NATIONAL HISTORIC SITE.
(a) Acquisition.--
(1) Authority.--The Secretary may acquire the Historic Site
for inclusion in the Fort Vancouver National Historic Site.
(2) Means.--
(A) In general.--Except as provided in paragraph
(2), an acquisition of the Historic Site under
paragraph (1) may be made by donation, purchase from a
willing seller with donated or appropriated funds, or
exchange.
(B) Exception.--Portions of the Historic Site owned
by the City may be acquired by donation only.
(b) Boundaries; Administration.--On acquisition of the Historic
Site--
(1) the boundary of Fort Vancouver National Historic Site
shall be modified to reflect the acquisition of the Historic
Site under subsection (a)(1); and
(2) the Secretary shall administer the Historic Site as
part of the Fort Vancouver National Historic Site, in
accordance with the laws (including regulations) applicable to
the National Park System.
