Consumer and Fuel Retailer Choice Act

Introduced March 2, 2017

AI-Generated Summary

Updated April 15, 2026 at 1:16 PM UTC

The Consumer and Fuel Retailer Choice Act changes the Clean Air Act’s rules on ethanol blends by adjusting the Reid vapor pressure (RVP) limits. It lets ethanol‑containing fuels that meet a 10 percent or higher blend threshold be treated differently, and it clarifies that waivers granted before 2017 can still be used if the fuel meets all other RVP requirements. The changes affect fuel producers, retailers, and consumers who use ethanol‑blended gasoline.

Key Provisions

  • Amends the Clean Air Act to add “or more” after “10 percent” in the RVP limitation language, allowing higher ethanol blend percentages.
  • Removes the phrase “additional alcohol or” from the RVP limitation text, simplifying the rule.
  • Clarifies that any fuel or additive that received a waiver before Jan 1 2017 can be sold if it meets all current RVP requirements, even if it exceeds the original waiver’s RVP limit.
