GI Bill Fairness Act of 2017

Introduced April 14, 2017

AI-Generated Summary

Updated April 15, 2026 at 2:47 PM UTC

The GI Bill Fairness Act of 2017 changes the law so that time a reservist spends receiving medical care from the Department of Defense counts as active‑duty service when determining eligibility for the Post‑9/11 Educational Assistance (the GI Bill). This gives reserve component members who are in medical treatment the same education benefits they would have earned if they were on active duty. The change applies retroactively to cover service dating back to the original 2008 GI Bill law.

Key Provisions

  • Amends 38 U.S.C. § 3301(1)(B) to add a new category (12301 (h)) that treats certain medical‑care periods for reservists as active‑duty time for GI Bill eligibility.
  • Makes the amendment retroactive, as if it had been in place when the Post‑9/11 Veterans Educational Assistance Act of 2008 was first enacted.
