Special Counsel Integrity Act

Introduced December 18, 2017

AI-Generated Summary

Updated April 15, 2026 at 7:39 PM UTC

The Special Counsel Integrity Act would make it harder to fire a special counsel by limiting who can remove them and why. It requires that only a Senate‑confirmed Attorney General (or a senior DOJ official if the Attorney General is recused) can remove a special counsel, and only for specific causes such as misconduct or conflict of interest. The law also gives a removed special counsel the right to challenge the removal in court, with a fast‑track three‑judge panel and possible Supreme Court appeal. It applies to special counsels appointed on or after May 17 2017.

Key Provisions

  • Only a Senate‑confirmed Attorney General, or a senior DOJ official if the Attorney General is recused, may discipline or remove a special counsel.
  • Removal is allowed only for misconduct, dereliction of duty, incapacity, conflict of interest, or other good cause, including DOJ policy violations.
  • The Attorney General (or designated official) must provide written notice of the specific reason for removal.
  • A removed special counsel can file a lawsuit challenging the removal; a three‑judge panel must decide the case within 14 days, with any appeal going directly to the Supreme Court.
  • If a court finds the removal unlawful, the special counsel is immediately reinstated.
