Settlement Trust Improvement Act of 2017

Introduced August 1, 2017

AI-Generated Summary

Updated April 15, 2026 at 5:44 PM UTC

The Settlement Trust Improvement Act of 2017 changes the tax code to clarify how Alaska Native corporations and their settlement trusts are treated for federal income tax. It lets certain Alaska Native Claims Settlement Act (ANCSA) payments assigned to settlement trusts be excluded from the corporation’s taxable income, and it creates a new deduction for contributions that corporations make to those trusts. The bill also adds reporting requirements and allows trust agreements to be updated to use the new rules.

Key Provisions

  • Adds a new Section 139G that excludes ANCSA payments assigned in writing to a Settlement Trust from a Native Corporation’s gross income, while requiring the trust to include the payments as its own income.
  • Creates a new Section 250 permitting Native Corporations to deduct cash or property contributions to Settlement Trusts, with limits based on taxable income and a 15‑year carryover for excess deductions.
  • Allows both corporations and Settlement Trusts to make annual elections to apply these provisions, and lets trusts defer income recognition on contributed non‑cash property until sale.
  • Requires Native Corporations to provide Settlement Trusts with detailed statements about deductible contributions by January 31 of the following year.
  • Permits amendment of Settlement Trust agreements within one year of enactment to enable the new election options, without needing beneficiary or shareholder votes.
