The PAID Act amends the Social Security Act to make Medicare secondary payer reporting more transparent. It requires the Secretary of Health and Human Services to give certain plans information about a claimant’s Medicare benefit status and the Medicare Advantage or prescription drug plans they have been enrolled in. The bill also directs $30 million to be deposited into the Medicare Improvement Fund.

Key Provisions

  • When an applicable plan asks about a claimant’s Medicare determination, the Secretary must disclose whether the claimant has been entitled to Medicare benefits in the past three years.
  • The Secretary must also provide the name and address of any Medicare Advantage (Part C) or prescription drug (Part D) plan the claimant is or was enrolled in during that period.
  • These disclosure requirements take effect for queries made on or after one year after the law’s enactment.
  • The bill changes the Medicare Improvement Fund deposit from $0 to $30 million.
  • Budgetary effects will be assessed according to the PAYGO statement submitted before the vote.
