The Capitol Police Retirement Reform Act of 2021 changes how overtime pay earned by Capitol Police officers is treated when calculating their retirement benefits. It allows overtime to be counted as basic pay for pension calculations, but only for officers who have at least 15 years of service at the time they separate. The bill also requires annual reporting of related data to the Office of Personnel Management.

Key Provisions

  • Adds a new category of overtime pay that can be considered basic pay for Capitol Police retirement annuity calculations.
  • Overtime counts toward pension only if the officer has completed at least 15 years of service before separation.
  • Applies a tiered percentage of overtime to basic pay based on years of post‑enactment service: 50% for less than 4 years, 75% for 4‑8 years, and 100% for 8 or more years.
  • Allows 100% of eligible overtime to be used for computing both regular and survivor annuities for service performed after the law takes effect.
  • Requires the Capitol Police to submit annual information to the Office of Personnel Management to implement these changes.
  • Makes a technical redesignation of a subsection related to physician comparability allowance.
