The Emergency Relief for Servicemembers Act amends the Servicemembers Civil Relief Act to let active-duty members cancel telephone, multichannel video programming, or internet service contracts they signed after receiving permanent change of station orders if they later receive a stop‑movement order because of an emergency. The change applies to contracts that become unusable due to the emergency and covers orders issued from March 1, 2020 onward. It affects servicemembers and the companies providing those communication services.

Key Provisions

  • Amends the SCRA provision on contract termination by removing the previous 90‑day relocation limitation and adding new eligibility criteria for termination based on (A) PCS orders to a location that can’t support the service, or (B) entering a contract after PCS orders and then receiving a stop‑movement order due to a local, national, or global emergency that prevents use of the service for an indefinite period or at least 30 days.
  • Makes the amendment apply retroactively to stop‑movement orders issued on or after March 1, 2020.
