The Capital Loss Inflation Fairness Act changes the tax code to let individuals deduct larger capital losses. It raises the annual loss deduction limit to $13,000 (or $6,500 for married filing separately) and ties that limit to inflation for years starting after 2023. The rule applies to all non‑corporate taxpayers and takes effect for tax years beginning after December 31, 2021.

Key Provisions

  • Increases the maximum deductible capital loss to $13,000 per year for individuals (or $6,500 for married filing separately).
  • Indexes the $13,000 limit to the cost‑of‑living adjustment for each calendar year beginning after 2023, using a formula based on the 2022 inflation rate.
  • Applies the new limits to taxable years beginning after December 31, 2021 for all non‑corporate taxpayers.
