Injunction Reform Act of 2022

Introduced December 21, 2022

AI-Generated Summary

Updated February 8, 2026 at 6:58 PM UTC

The Injunction Reform Act of 2022 would change federal law to limit which courts can issue nationwide injunctions that stop the enforcement of federal statutes, regulations, or orders against parties who are not directly involved in a lawsuit. Only the U.S. District Court for the District of Columbia, the U.S. Court of Appeals for the D.C. Circuit, and the Supreme Court would be allowed to issue such orders, and the non‑party must be represented by a party in the case. This affects any federal court attempting to issue a national injunction and the non‑parties subject to those orders.

Key Provisions

  • Adds a new Section 2285 that bars any U.S. court other than the D.C. District Court, the D.C. Circuit Court of Appeals, or the Supreme Court from issuing orders that restrain enforcement of federal law against non‑parties unless the non‑party is represented by a party in the case.
  • Amends the table of sections in Chapter 155 of Title 28 to insert the new Section 2285.
