The Plastic Pellet Free Waters Act would direct the EPA to create a rule that stops plastic pellets and other pre‑production plastic material from being released into wastewater, stormwater, or runoff. The rule must be issued within 60 days of the law’s enactment and would apply to facilities that make, use, package, or transport these pellets, as well as any point sources that handle them. It also requires the prohibition to be reflected in all relevant EPA and state water permits and performance standards.

Key Provisions

  • EPA must issue a final rule within 60 days prohibiting discharge of plastic pellets and other pre‑production plastic materials from facilities regulated under CFR parts 414 or 463.
  • The prohibition also applies to any point source that makes, uses, packages, or transports plastic pellets or similar materials.
  • The rule must be incorporated into all wastewater, stormwater, and other permits issued by EPA and delegated state programs for affected facilities.
  • The rule must be reflected in all EPA performance standards applicable to those point sources.
