CREW Act

Introduced June 24, 2021

AI-Generated Summary

Updated February 8, 2026 at 4:47 AM UTC

The Civilian Reservist Emergency Workforce (CREW) Act amends the Stafford Disaster Relief and Emergency Assistance Act to extend federal employment and re‑employment protections, similar to those under USERRA, to FEMA’s intermittent personnel who serve in disaster response or training. It treats their absence from civilian jobs as a matter of military necessity and changes related statutes to include these reservists in the same benefit categories as uniformed service members.

Key Provisions

  • Adds a new subsection to §306 of the Stafford Act granting USERRA employment and re‑employment rights to FEMA intermittent personnel and trainees, and treats their required notice of absence as precluded by military necessity determined by the FEMA Administrator.
  • Amends 38 U.S.C. §4303 to explicitly include FEMA intermittent personnel in the list of individuals eligible for employment and re‑employment protections, and updates paragraph numbering accordingly.
  • Modifies 38 U.S.C. §4312(b) to change notice‑to‑employer requirements, defines who can determine military necessity for FEMA intermittent personnel (the FEMA Administrator) and for National Disaster Medical System appointees (the HHS Secretary), and makes those determinations not subject to judicial review.
