AI-Generated Summary

Updated February 8, 2026 at 7:01 AM UTC

The School Infrastructure Modernization Act of 2021 changes the tax code so that money spent on renovating public school buildings can qualify for the federal rehabilitation tax credit. This lets school districts and other entities that fund school repairs claim a credit, encouraging upgrades to school facilities. The Treasury must report to Congress within five years on how many schools and students benefit, especially in low‑income areas. The credit applies to projects placed in service after Dec. 31, 2021.

Key Provisions

  • Adds a new sub‑clause to the rehabilitation credit rules that specifically includes public school buildings, allowing their renovation costs to qualify for the credit.
  • Requires the Secretary of the Treasury, after consulting other agencies, to report to Congress within five years on the number of schools and students impacted, expenditures, and data on low‑income community projects.
  • Sets the effective date so the credit applies only to property placed in service after Dec. 31, 2021.
