The GATES Act amends the Food Security Act of 1985 to create an exception to certain payment limits for people or entities that earn most of their income from farming, ranching, or forestry. If at least 75% of their average adjusted gross income comes from those activities and they provide proof, the usual payment caps do not apply. This change affects agricultural producers and entities receiving federal farm payments or benefits.

Key Provisions

  • The exception applies when 75% or more of the person’s or entity’s average adjusted gross income is derived from farming, ranching, or forestry.
  • Recipients must submit documentation to the Secretary proving the income source.
  • Defines “excepted payment or benefit” as the type of payment described in paragraph (2)(C).
