To exclude individuals who are not citizens of the United States from the number of persons used to determine the apportionment of Representatives and the number of electoral votes.

Introduced November 30, 2023

AI-Generated Summary

Updated January 20, 2026 at 1:18 PM UTC

The bill changes the way the population count used for congressional representation and electoral votes is calculated by removing non‑citizens from that count. It amends the Census Act so that only U.S. citizens (and those not taxed) are included when determining how many Representatives each state gets and how many electoral votes it receives. The change would start with the 2030 decennial census and apply to all future censuses, affecting the distribution of seats in the House and electoral college among the states.

Key Provisions

  • Amends the Census Act to exclude individuals who are not U.S. citizens from the population total used for apportioning Representatives and electoral votes.
  • The exclusion takes effect for the apportionment based on the 2030 census and all subsequent decennial censuses.
  • As a result, each state’s share of House seats and electoral votes will be calculated using only the citizen population, potentially altering the current distribution.
