Plastic Pellet Free Waters Act

Introduced July 18, 2023

AI-Generated Summary

Updated January 20, 2026 at 10:04 AM UTC

The Plastic Pellet Free Waters Act directs the EPA to create rules that stop plastic pellet and other pre‑production plastic material pollution from entering water bodies. Within 60 days of the law’s enactment, the agency must issue a final rule that bans such discharges from facilities that make, use, package, transport, or otherwise handle these materials. The rule applies to facilities already regulated under EPA’s hazardous waste (part 414) and underground storage (part 463) programs, as well as any point source covered by the Clean Water Act. These new limits must be built into all relevant wastewater, stormwater and other permits and performance standards.

Key Provisions

  • EPA must issue a final rule within 60 days prohibiting discharge of plastic pellets or other pre‑production plastic materials from facilities regulated under CFR parts 414 or 463.
  • The rule also bans discharge of these materials from any point source that makes, uses, packages, or transports plastic pellets or similar pre‑production plastics.
  • All EPA‑issued and state‑delegated wastewater, stormwater and related permits must reflect the new prohibitions.
  • Performance standards under Clean Water Act section 312(p) must incorporate the same prohibitions for applicable point sources.
