The Chronic Disease Management Act of 2023 changes the tax code so that high‑deductible health plans can cover preventive services for chronic illnesses before the enrollee’s deductible is met. It sets criteria for what qualifies as preventive care and lets insurers treat the receipt of such care as evidence of a chronic condition diagnosis, benefiting people with chronic diseases who are enrolled in these plans.

Key Provisions

  • Amends the Internal Revenue Code (Section 223(c)(2)) to add a new category of preventive care for chronic conditions that can be provided before an enrollee meets their high‑deductible health plan deductible.
  • Defines qualifying preventive services or items as low‑cost, supported by medical evidence showing they efficiently prevent worsening of a chronic condition or a secondary condition, and backed by clinical evidence that they are likely to avoid higher‑cost treatments.
  • Allows an enrollee who receives such prescribed preventive care to be presumed to have been diagnosed with the chronic condition for which the care is customarily prescribed.
  • The amendment takes effect for coverage periods beginning after the law is enacted.
