The H‑1B Visa Fraud Crackdown Act raises the civil fines and criminal prison terms for serious violations of the H‑1B nonimmigrant visa program and for immigration‑related document fraud. It makes the penalties much harsher for employers or individuals who break the rules, aiming to deter abuse of the program. The changes affect anyone who files false H‑1B petitions or uses fraudulent documents in immigration processes.

Key Provisions

  • Increases the civil fine for certain H‑1B violations from $5,000 to $100,000 and raises the minimum prison term from 2 to 5 years.
  • Raises another civil fine for H‑1B violations from $35,000 to $250,000 and the minimum prison term from 3 to 10 years.
  • Boosts civil penalties for immigration document fraud: the lower range goes from $250‑$2,000 to $1,000‑$10,000, and the higher range goes from $2,000‑$5,000 to $20,000‑$50,000.
