The Workers’ Retirement Savings Protection Act of 2026 amends the Employee Retirement Income Security Act (ERISA) to treat anyone who gives retirement investment advice for a fee as a fiduciary. It expands fiduciary duties to cover advice on securities, investment strategies, and account roll‑overs for both employer‑sponsored plans and individual retirement accounts. The change aims to protect workers’ retirement savings by ensuring advisors act in the best interests of plan participants.

Key Provisions

  • Defines a person who provides retirement investment advice for any fee or compensation (including commissions, revenue sharing, gifts, etc.) as a fiduciary under ERISA.
  • Requires that such advice be individualized to the specific needs of the plan or individual account to trigger fiduciary status.
  • Expands the definition of “plan” to include employee benefit plans as well as individual retirement accounts and annuities.
  • Specifies that any compensation tied to a recommended transaction or advice makes the advisor a fiduciary, even if the fee is indirect or non‑cash.
  • Repeals the existing regulation at 29 CFR 2510.3-21(c) that previously governed fiduciary standards for investment advice.
