Rural Surgery Sustainability Act of 2026

Introduced October 5, 2026

AI-Generated Summary

Updated October 8, 2026 at 3:14 AM UTC

The Rural Surgery Sustainability Act of 2026 changes Medicare payment rules for certified registered nurse anesthetists (CRNAs) to help keep surgical services viable in rural hospitals. It raises the number of procedures that can qualify for cost‑pass‑through payments, adds exceptions for hospitals that have a labor‑and‑delivery unit, and requires regular review and inflation‑adjusted updates. The changes also remove hour‑service limits for those hospitals and call for a report on sustainable payment options.

Key Provisions

  • Increase the Medicare cost‑pass‑through cap for CRNAs from 500 to 1,250 procedures.
  • Exclude hospitals with an active labor and delivery unit from that cap for the year.
  • Require the HHS Secretary, in consultation with the American Association of Nurse Anesthetists, to review and update procedure‑volume and hour limits at least every two years.
  • Adjust yearly payment limits by the percentage increase in the Medicare Economic Index.
  • Eliminate any total‑hours‑of‑service limit for CRNAs in hospitals that have a labor‑and‑delivery unit, starting in 2027.
  • Align the overall hours‑limit with the new higher procedure cap.
  • Mandate that the Medicare Payment Advisory Commission submit a report to Congress within one year on including on‑call CRNA services and on sustainable payment modifications.
