The Food is Medicine Access Act of 2026 changes the Social Security Act so that payments for certain food and nutrition services are no longer treated as illegal kickbacks. It lets health‑care providers be paid for things like medically‑tailored meals, nutrition counseling, food vouchers, and transportation when these services are part of an evidence‑based program aimed at preventing or managing diet‑related health conditions. The rule applies to individuals the Secretary of Health and Human Services identifies as needing such services.

Key Provisions

  • Adds a new subparagraph (M) that lists food and nutrition items and services (e.g., pantry stocking, nutrition prescriptions, medically‑tailored groceries/meals, transport, nutrition therapy, education, vouchers) that can be paid for without violating anti‑kickback laws.
  • The Secretary of HHS must define which classes of individuals and which types of health‑care providers are eligible, taking into account clinical and financial needs and risk of exploitation.
  • The Secretary must set fraud‑prevention measures and may require providers to have written policies approved by their governing bodies for delivering these services.
  • The exemption takes effect 18 months after the law is enacted.
