The Right to Re‑Enroll Act of 2026 would change the Affordable Care Act so that health‑insurance exchanges must offer a special enrollment period when a plan’s network loses a provider or facility. It applies to anyone enrolled in a marketplace (exchange) health plan and aims to protect them from losing coverage or facing higher costs when their usual doctors leave the plan’s network.

Key Provisions

  • Adds a new rule that triggers a special enrollment period if a plan’s contract with any network provider or facility ends, regardless of why it ends, for plan years starting Jan. 1, 2027.
  • Requires exchanges to give affected enrollees a 60‑day window, beginning on the date the contract ends, to switch to another qualified health plan.
  • Mandates that plans continue to cover services from the discontinued provider at the same cost‑sharing level as if the contract had not ended, provided the member used the provider within the 90‑day period before termination or was assigned to that provider.
  • Requires the plan to notify each affected enrollee within 7 days of the network change, explaining eligibility for the special enrollment period, how to enroll, and that switching plans will reset any deductible or out‑of‑pocket amounts.
