7(a) Loan Agent Oversight Act

Introduced March 3, 2025

AI-Generated Summary

Updated November 24, 2025 at 2:15 AM UTC

The 7(a) Loan Agent Oversight Act amends the Small Business Act to require the SBA to produce an annual report on the use of 7(a) loan agents. The report gathers statistics on agent activity, fraud, fees, risk, and loan terms, and explains how the agency interacts with agents. This aims to increase transparency and oversight of the agents who help small businesses obtain SBA 7(a) loans.

Key Provisions

  • The SBA Director must submit an annual report to Congress that includes data on 7(a) loan agents, such as how many agents are assisting loan applicants and how they are categorized.
  • The report must detail the number of fraudulent loans where a 7(a) agent was used, and the rate at which the SBA purchases loans that involved an agent.
  • It must disclose the total amount and number of referral fees paid to agents, showing whether the borrower or the lender paid them.
  • The report must analyze the risk posed by any agents responsible for at least 1% of loan volume or dollar value, without naming individual agents.
  • It must include an analysis of interest rates on loans that used an agent’s services and describe how the SBA communicates with these agents.
