The Hydropower Licensing Transparency Act changes the Federal Power Act to make the Federal Energy Regulatory Commission (FERC) send Congress a yearly report on the status of pending hydropower licensing and relicensing cases. The bill aims to give lawmakers and the public clearer insight into how long it takes to issue new, subsequent, or original hydropower licenses. It mainly affects FERC, current and prospective hydropower license holders, and any state, tribal, or local groups involved in the licensing process.

Key Provisions

  • FERC must submit a report to Congress no later than 180 days after the law takes effect and then each year thereafter.
  • The report must cover (a) new licenses and subsequent licenses where certain sections have been waived and the current licensee has signaled intent to reapply at least three years earlier, and (b) original licenses under section 4(e) where a citizen, state, tribe, or other entity has signaled intent at least three years earlier but the license has not yet been issued.
  • For each listed license, the report must include the date of the intent notice, any docket number, whether an application has been filed, the current status and expected issuance date, dates of upcoming proceedings, and a description of any required actions by the licensee or agencies.
  • All information in the report must be broken out separately for new licenses, subsequent licenses, and original licenses.
