The Shivwits Band of Paiutes Jurisdictional Clarity Act lets Utah courts hear civil lawsuits that involve the tribe and occur on its trust lands, while keeping the tribe’s sovereign immunity intact. It also treats contracts and leases on those lands as interstate commerce, making related lawsuits federal questions. The bill updates a historic leasing law to explicitly mention the Shivwits Band’s trust land.

Key Provisions

  • Defines “Indian lands” as land held in trust for the Shivwits Band of Paiutes or land with a federal restriction against alienation.
  • Gives the State of Utah civil jurisdiction over any lawsuit that involves the Shivwits Band of Paiutes and arises on those Indian lands.
  • States that contracts or leases involving the Indian lands count as “commerce” and that related lawsuits are federal questions under U.S. law.
  • Clarifies that the tribe’s sovereign immunity is not removed; the tribe can still choose to waive it.
  • Amends a 1955 leasing statute to specifically reference land held in trust for the Shivwits Band of Paiutes.
