A bill to expand the sharing of information with respect to suspected violations of intellectual property rights in trade.

Introduced August 1, 2025

AI-Generated Summary

Updated August 8, 2026 at 7:40 AM UTC

The bill amends the Tariff Act of 1930 to broaden the types of information that can be shared about suspected intellectual‑property violations in imported goods. It lets U.S. Customs share nonpublic data from online marketplaces, freight forwarders and similar parties with those who may be affected, and requires those parties to be notified. The changes affect importers, online platforms, freight forwarders, customs officials and any other parties with a legitimate interest in the merchandise.

Key Provisions

  • Replaces the term “suspects” with “has a reasonable suspicion,” tightening the standard for sharing information.
  • Expands the description of merchandise to include packing materials, containers, and labels, not just the product itself.
  • Adds new provisions allowing Customs to provide nonpublic information gathered from online marketplaces, consignment operators, freight forwarders, or similar entities to interested parties.
  • Requires that anyone receiving such nonpublic information be notified about what was transmitted, according to regulations set by the Secretary.
  • Allows the Commissioner to determine any other party with an interest in the merchandise that may receive the information.
