The Safe Access to Cash Act of 2026 adds new federal crimes for offenses involving automated teller machines (ATMs). It creates penalties for robbing or intimidating ATM users and service personnel, for breaking into or stealing from ATMs, and for related violent conduct. The law applies to all ATMs, whether they are on a bank’s premises or located elsewhere, and affects criminals, ATM owners, banks, credit unions, and their customers.

Key Provisions

  • Creates a felony for using force, intimidation, or extortion to take money or property from anyone using or servicing an ATM, punishable by up to 20 years in prison.
  • Establishes property theft offenses: breaking into or stealing from an ATM with more than $1,000 in value carries up to 10 years, while theft of $1,000 or less carries up to 1 year.
  • Makes it a crime to receive, possess, conceal, store, barter, sell, or dispose of property stolen from an ATM, with penalties matching those for the original thief.
  • Adds harsher penalties for violent acts connected to ATM crimes: assault with a dangerous weapon can lead to up to 25 years, and killing or forced accompaniment can result in up to 30 years or life imprisonment.
  • Defines “ATM” broadly to include any network‑connected machine used for withdrawals, deposits, or balance inquiries, regardless of its physical location or ownership.
