The School Infrastructure Modernization Act of 2026 changes the tax code so that money spent on renovating public school buildings can qualify for the federal rehabilitation tax credit. This makes it easier for school districts to get tax benefits for upgrading their facilities, and it applies to projects that start after December 31, 2026. The Treasury must report to Congress within five years on how the change is used and its impact.

Key Provisions

  • Amends Section 47(c)(2)(B)(v) of the Internal Revenue Code to add a new sub‑clause that excludes public schools from the limitation that previously barred them from the rehabilitation credit.
  • Requires the Secretary of the Treasury, after consulting with relevant agencies, to report to Congress within five years on the number of public school facilities and students benefiting, especially in low‑income areas, and the amount of qualified expenditures.
  • Sets the effective date of the amendment for property placed in service after December 31, 2026.
