The Build American Efficiency Act clarifies how the Department of Housing and Urban Development (HUD) can use documentation to verify that projects receiving HUD financial assistance meet the domestic‑content requirements of the Build America, Buy America Act. It says that records created under the Make It American Process Standard (NEMA 70901‑2024) or its approved successors count as sufficient proof of compliance. The bill also makes clear that HUD cannot force recipients to use that specific documentation nor block other lawful certification methods, and it allows similar standards if they provide an auditable certification process.

Key Provisions

  • HUD must treat documentation produced under the Make It American Process Standard (NEMA 70901‑2024) or an approved successor as adequate evidence for confirming domestic‑content compliance.
  • The rule does not require recipients to use that specific documentation, nor does it prevent them from using other legally permissible certification methods.
  • HUD may also accept documentation from other standards that are similar to the Make It American Process Standard, provided they offer an auditable and verifiable domestic‑content certification.
