National Guard and Reserve called or ordered to active duty for a
period of more than 30 days receive a basic allowance for housing at
the same rate as similarly situated members of the regular components
of the uniformed services.

which was read twice and referred to the Committee on Armed Services

A BILL

To amend title 37, United States Code, to require that members of the
National Guard and Reserve called or ordered to active duty for a
period of more than 30 days receive a basic allowance for housing at
the same rate as similarly situated members of the regular components
of the uniformed services.

Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ``National Guard and Reserves Housing
Equity Act of 2005''.

SEC. 2. BASIC ALLOWANCE FOR HOUSING FOR RESERVE MEMBERS.

(a) Equal Treatment of Reserve Members.--Paragraph (3) of
subsection (g) of section 403 of title 37, United States Code, is
amended--
(1) by inserting after ``(3)'' the following new sentence:
``The rate of basic allowance for housing to be paid to a
member of a reserve component who is called or ordered to
active duty for a period of more than 30 days shall be equal to
the rate in effect for similarly situated members of a regular
component of the uniformed services.''; and
(2) by striking ``less than 140 days, unless the call or
order to active duty is in support of a contingency operation''
and inserting ``30 days or less''.
(b) Conforming Amendment Regarding Members Without Dependents.--
Paragraph (1) of such subsection is amended--
(1) by striking ``in support of a contingency operation''
both places it appears; and
(2) by inserting ``for a period of more than 30 days''
after ``active duty'' both places it appears.
