AI-Generated Summary

The Fairness for Our Hospitals Act of 2017 changes the definition of a Medicare‑dependent hospital so that hospitals located in states that have no rural areas can qualify, provided they meet the existing eligibility criteria. It also directs the Health and Human Services Secretary to set up a system to pay back any Medicare shortfalls those hospitals experience because of the rule change.

Key Provisions

  • Amends the Social Security Act to add a new condition allowing hospitals in all‑urban states (states with no rural area) to be considered Medicare‑dependent hospitals if they meet the same criteria as rural hospitals.
  • Requires the HHS Secretary, within 120 days of the law’s enactment, to create a process to reimburse any underpayments to hospitals that result from this definition change.
