Servicemember Family Burial Act

Introduced November 9, 2017

AI-Generated Summary

Updated April 15, 2026 at 7:08 PM UTC

The Servicemember Family Burial Act expands burial benefits in national cemeteries to cover spouses and dependent children of active‑duty service members who die while serving under conditions other than dishonorable. It directs the Department of Veterans Affairs to provide headstones, markers, and burial space for these family members, using a statement from a general court‑martial convening authority as proof of eligibility. The changes apply to deaths occurring before October 1, 2024.

Key Provisions

  • Amends the eligibility rules for headstones and markers to include the spouse of an active‑duty service member (under non‑dishonorable conditions) and the member’s eligible dependent children, with eligibility shown by a statement from a general court‑martial convening authority.
  • Amends the rules for interment in national cemeteries to allow burial of the spouse, minor child, and, at the Secretary’s discretion, an unmarried adult child of an active‑duty service member under the same non‑dishonorable conditions, again requiring a statement from a general court‑martial convening authority.
  • All new benefits apply only to deaths that occur before October 1, 2024.
