Gold Star Spouses Leasing Relief Act

Introduced May 18, 2018

AI-Generated Summary

Updated April 15, 2026 at 10:08 PM UTC

The Gold Star Spouses Leasing Relief Act amends the Servicemembers Civil Relief Act to give surviving spouses of service members who die while on active duty the right to end a lease the service member was holding. It allows the spouse to terminate the lease within one year of the service member’s death. This change helps Gold Star spouses avoid being bound to lease obligations after their loved one’s death.

Key Provisions

  • Adds a new paragraph to Section 305(a) of the Servicemembers Civil Relief Act allowing a spouse of a deceased lessee to terminate the lease within a one‑year period after the death, if the service member died while in military service, National Guard, or Reserve duty.
  • Updates headings in the same section by removing the phrase “by Lessee” and changing “In general” to “Termination by lessee,” reflecting the new termination right.
